1. Application of Terms and Conditions:  These Terms and Conditions apply to Circle In’s e-gift card prize draw promotion (the “Promotion”) extended to selected Circle In subscribers (each, a “Subscriber”).  By participating in the Promotion, Subscribers are deemed to have accepted these Terms and Conditions.

    

2. Promoter’s details:  The Promoter of the Promotion is Circle In Pty Ltd (ABN 74 609 227 018), having its registered office at Suite G6, 175 Sturt St, Southbank, Victoria 3006. Australia (“Circle In”).

3. Duration of Promotion:  The Promotion is scheduled to run from 27th February until 31st March 2023 Australian Eastern Daylight Time (inclusive) or until any earlier close of the Promotion  by Circle In, which it may do so at its discretion.

4. Eligibility:   The selection of Subscribers for participation in the Promotion is at Circle In’s discretion. To be eligible to go into the draw to win a prize, a Subscriber must have completed their full profile information on Circle In. Eligibility is further restricted to individuals aged 18 years or over. Employees of Circle In and their immediate families are ineligible to enter.  Circle In reserves the right to, at any time, verify any individual’s eligibility for the Promotion and may disqualify any individual from eligibility if it has reason there has been non-compliance with these Terms and Conditions.

5. Prizes:  The prizes for winning Subscribers are awarded in the form of e-gift cards, as follows:
   
   

   • For Australia, New Zealand or US based Subscribers – ‘Prezzee’ Gift Card up to a value of AUD$200;

   • For UK based Subscribers – John Lewis gift card of value £150; and 

   • Other Subscribers based in other regions – ‘GoGift Global’ Gift Card up to the value of $200 AUD.

   
   Circle In will arrange for provision of e-gift cards to the Promotion winners.  e-gift cards awarded in the Promotion are not transferable or exchangeable and cannot be taken as cash.  Circle In reserves discretion to change the value of the prize to be awarded from time to time while the Promotion is ongoing.  e-gift cards that are awarded as prizes are subject to the applicable e-gift card terms and conditions, including any age restrictions that may apply to purchases.

6. Selection of winners:  Circle In will draw winners from the pool of eligible Subscribers.  The winners will be notified on or before 7th April 2023.  Only the winning Subscriber(s) will be notified by email.  Winners must respond within 72 hours of the notification email being sent – or the prize may be re-allocated. Relocation will be based on the remaining pool of eligible Subscriber(s). Whilst Circle In reserves discretion to announce the names of the winning Subscriber(s), it will not be under any obligation to do so.  

7. Collection of personal information:  Circle In collects personal information from Subscribers for the purpose of conducting the Promotion and may, in the course of business, disclose such personal information to third parties, as required.   Personal information collected during the course of the Promotion is collected, stored and processed in accordance with Circle In’s Privacy Policy.

8. Exclusion of liability:   Circle In will not be liable for any loss (including loss of opportunity) or damage (including, but not limited to, direct, indirect or inconsequential loss) or personal injury in relation to the Promotion or the use of any prize awarded.

9. Circle In’s discretion:  Circle In’s decision in relation to the Promotion and in the exercise of any discretion reserved to it in these Terms and Conditions is final and no correspondence will be entered into.   Circle In reserves the right to modify, suspend or terminate the Promotion, including these Terms and Conditions, without notice.

10. Governing law:  The Promotion and these Terms and Conditions are governed by the laws of Victoria, Australia.
